ART Law & Compliance (Prarambh IVF)
At Prarambh IVF, we strictly adhere to the Assisted Reproductive Technology (Regulation) Act, 2021, and the Surrogacy (Regulation) Act, 2021. Our goal is to provide ethical, transparent, and legal fertility treatments to our patients in Ahmedabad.
1. Registration & Licensing
Prarambh IVF is a registered fertility clinic under the National Assisted Reproductive Technology and Surrogacy Registry of India. We follow all clinical and laboratory standards mandated by the government to ensure patient safety and high success rates.
2. Patient Eligibility
Under Indian law, ART services (including IVF and IUI) are available to:
- Married Couples: Infertile couples where the woman is aged 21–50 years and the man is aged 21–55 years.
- Single Women: An unmarried, widowed, or divorced woman between the ages of 21–50 years is legally eligible to avail ART services.
3. Ethical Guidelines & Rights
- Informed Consent: We ensure every patient receives clear, written information in their preferred language about the procedures, risks, costs, and chances of success before any treatment begins.
- Confidentiality: As per the Act, your identity and medical records are kept strictly confidential and shared only with the National Registry as required by law.
- Rights of the Child: A child born through ART is legally deemed the biological child of the commissioning couple/woman and is entitled to all legal rights and privileges.
4. Donor Regulations (Gamete Donation)
- Anonymity: The identity of gamete (egg/sperm) donors is kept confidential and is not shared with the patients.
- Screening: All donors undergo rigorous medical and genetic screening as per government protocols.
- Altruistic Nature: In India, gamete donation is an altruistic act. Donors must meet specific age and health criteria (e.g., egg donors must be married women aged 23–35 with at least one living child).
5. Prohibited Practices
In strict compliance with Indian Law, Prarambh IVF does NOT engage in:
- Sex Selection: We do not provide or advertise any services for gender determination or selection (strictly prohibited under the PC-PNDT Act).
- Commercial Surrogacy: We only support altruistic surrogacy for eligible Indian couples as per the Surrogacy Act 2021.
- Unauthorized Storage: We follow strict timelines for the storage and disposal of gametes and embryos.
